At Guarantee Wine Storage we understand that wine is a living, breathing thing and that no matter how environmentally sound the cellar is one wants to have full coverage against fire, theft, breakage, water damage and a host of other catastrophes. It is recommended to fully insure one's prized collection for not only cellaring the wine but also for when it is in transit.
We offer several coverage options to protect one's collection.
OPTION 1: NO LIABILITY OR INDEMNITY
The Company shall not be responsible for any damage or injury that may happen to Tenant or Tenant's property stored in the storage space from any cause whatsoever during the period covered by the Lease, and Tenant hereby expressly releases the Company from and agrees to indemnify the Company against any and all claims for such loss, damage or injury, including, without limitation, costs and reasonable attorneys' fees incurred by the Company in connection therewith. All property stored in the Facility is placed there at Tenant's sole risk, and the Company shall have no liability whatsoever for any loss or damage. The Company shall in no event be liable for consequential damages resulting from the physical loss or damage to any property.
OPTION 2: LIMITED DECLARATION OF VALUE
The occupant is required to declare in writing the total value of the property. The customer declares that damages are limited to one hundred ($100.00) dollars for each case lost or damaged. For purposes hereof, a "case" shall constitute twelve (12) 750 ml bottles or the equivalent to such volume. The Customer further declares that he or she will look to his or her own insurance for any additional damages. Customer hereby waives any right of subrogation against the Company, its agents and employees for any loss or damages to the stored goods, and to notify its carrier of the terms of such waiver. The Company shall not, in any event, be liable for consequential or special damages resulting from the physical loss or damage to any property. As a condition precedent to recovery, all claims must be in writing, supported by a paid freight bill and filed with the Company within sixty (60) days after delivery of the goods.
OPTION 3: EXCESS VALUATION
At the time of the initial storage by the occupant of any case of wine, the inventory will be based on an actual physical inventory taken of the contents of the containers. The occupant shall supply Guarantee Wine Storage with a value of the inventory (stated value). Such stated value will be the value used for the foregoing two percent (2%) charge for the calendar year. For each additional case or box stored during the calendar year, a cash value will be established as provided above and the inventory list will be modified and mailed to you. A 2% charge will then be billed monthly for such additional stored wines for the remainder of the calendar year. Each annual 2% charge will be based on the latest stated cash value reflected on the list. Under this option, the wine will be covered not only for storage but also in transit.
